Our privacy policy
EMI Music Italy S.p.A. (hereafter "EMI") is aware of the delicate issue of the privacy of all visitors to its websites and, in general, does not automatically collect personal data about the visitors to its websites. EMI records the e-mail addresses and other personal data allowing the identification of visitors only if said data is provided on a voluntary basis by said visitors.
Registration of your personal information On connection, EMI’s internet servers automatically record a series of items of general information regarding visitors (eg. type of browser used, type of operating system used and the domain name of the visitor’s service provider). This information is basically used for internal audits of the number of site visitors, but only in aggregate form, without the possibility that individuals may be identified. This information may also be transmitted to third parties for marketing, promotion and other activities. Information permitting individual persons to be identified may be collected by EMI only in the event that visitors to the website intentionally submit forms to register for a competition, subscribe to a newsletter/artist information service or who take part in other forms of promotional initiative. Said personal information is recorded and retained by EMI, which will not sell or in any other way transfer it to subjects outside the company, unless explicit consent to act in this way has first been obtained or in specific cases in which the presentation of said data is required by law, court order or government provision. This information will be used by EMI for internal promotion and marketing purposes, as well as to gain a better understanding of how visitors use its websites and to support related promotional initiatives, as well as to offer users a broader entertainment offering during online sessions. If said information is transmitted by EMI to third parties for marketing, promotional or other purposes, EMI will process said information in such a way as to make it impossible to identify individual users. Sometimes EMI uses voluntarily provided e-mail addresses and other information which allows individual users to be identified in order to contact the visitors to its websites. For example, this may include the sending of e-mail messages to visitors who provide their own e-mail addresses for particular reasons, such as receiving e-mail newsletters/reports or advice that users have won competitions organised by us. All e-mail newsletters/reports contain instructions on how to be removed from the mailing list. Users are advised that if they voluntarily disclose their personal information (eg: username, e-mail address, telephone number) in newsletters or chat areas, this information could be collected and used illegitimately by third parties, with the risk of receiving unsolicited messages from third parties. EMI declines all responsibility as regards the actions or policies of third parties who collect information disclosed by users in chat areas. Cookies Some EMI websites may use cookies. Cookies contain information transmitted by a website and saved to the user’s hard disk for archive purposes. EMI never uses cookies to obtain information from your PC and any cookies used contain no information which could be used to identify individual persons. Cookies work by saving your passwords and favourite sites, improving speed of access and allowing us to offer you information that reflects your interests. Most browsers are initially set up to accept cookies. If you prefer, you can set your browser to refuse cookies or advise you when one is sent. This setting may nevertheless affect the speed at which some pages of certain EMI sites are loaded and specifically those which have already visited. For parents: the privacy issue EMI recommends that parents or their substitutes accompany their children when surfing the web and take part in the interactive sessions offered by the website. As regards the disclosure of personal information, EMI has a policy that no information be transmitted to or recorded on an EMI site by minors without the prior written consent of their parents or those persons substituting them. We also recommend the use of software to protect minors from accessing unsuitable sites. Acceptance of these conditions By accessing this site you expressly accept the privacy policy adopted by the website EMIMUSIC.IT. If you do not accept the conditions of this policy you are kindly asked not to access our websites. EMI reserves the right, at its own discretion and at any time, to modify, change, add or cancel part of the text of this policy. Please visit this page periodically to check on any changes. consent pursuant to Italian Law 675, 31 December 1996 The purpose of law 675/96 is to guarantee that personal information is processed without affecting personal rights, fundamental freedoms and dignity, with particular reference to confidentiality and personal identity. The law states that all persons must be informed about why their personal information is being recorded and how it will be used, and that the interested party must be asked for express written consent. The data processing for which our Company asks your consent is required to enable you to use the services as described above and to correctly exercise your rights. We would like to inform you that the information recorded during registration includes, but is not limited to: family name, given name, sex, date and place of birth, nationality, residence, domicile, home telephone number, mobile telephone number and educational qualifications. This information is used with and without the support of electronic equipment pursuant to law 675/1996 for the following purposes: - to provide the services which are the subject of this contract; - to prepare statistics and market research studies; - to set up the link register. Your personal data is handled in the name of Emi Music Italy SpA, with registered office in Milan, Piazza San Babila 3. You are advised that the following persons have been appointed in charge of this function pursuant to art. 8 of Law 675/96: Riccardo Clary with elected domicile for the purposes of his post at Emi Music Italy SpA. Art. 13 Law 675/96 1. In relation to the processing of personal information, you, the interested party, have the right to: a) know, by means of free access to the register provided for in art. 13, clause 1a), that data regarding you may be subject to processing; b) be informed about the matters indicated in art. 7 clause 4a), b) and h); c) obtain the following at the expense of the incumbent or other person responsible, without delay: 1) confirmation of the existence or non-existence of personal data regarding you, even if it has not yet been registered, and communication in an intelligible form of said data and its origin, as well as the method and purpose the treatment is based on (requests for such information may be renewed at intervals of no fewer than ninety days, unless justified reasons are given); 2) deletion, transformation into an anonymous form or blocking of data processed in default of the law, including data which need not be kept in relation to the purposes for which it was collected or subsequently processed; 3) updating, correction or, if it is in your interest, integration of data; 4) certification that notice of operations under 2) and 3), also as regards their content, has been given to the subjects to which the information has been communicated or disclosed, except when fulfilment of same is impossible or would require resources manifestly disproportionate with respect to the right protected; d) to partially or wholly oppose, for legitimate reasons, the treatment of personal data regarding you even if relevant to the purpose for which it was collected; e) to partially or wholly oppose the processing of personal data regarding you for the purposes of commercial information or mailing of advertising or direct sales material or for conducting market research or interactive commercial communications, and to be informed by the incumbent, no later than when such data are communicated or disclosed, that you may exercise this right free of charge. 2. For each of the requests provided for in clause 1, c), 1), you may be asked, if it is confirmed that there is no data regarding you, for a contribution towards expenses not to exceed the actual costs incurred in accordance with the methods and within the limits established by the rules set forth in art. 33, clause 3. 3. The rights provided for in clause 1 referring to personal data concerning deceased persons may be exercised by anyone with an interest in so doing. 4. In exercising the rights provided for in clause 1, you may act through natural persons, corporate persons or associations with written power of attorney. 5. The law regarding the professional privilege of journalists is applicable only with respect to sources of news. |
